A fatwā (Arabic: فتوى) in Islam is the technical term for the legal judgment or learned interpretation that a qualified jurist or mufti can give on issues pertaining to the Islamic law. In Sunni Islam any fatwā is non-binding. The person who issues a fatwā is called, in that respect, a Mufti. This is not necessarily a formal position since most Muslims argue that anyone trained in Islamic law may give an opinion (fatwā) on its teachings. If a fatwā does not break new ground, then it is simply called a ruling. An analogy might be made to the issue of legal opinions from courts in common-law systems. Fatwās generally contain the details of the scholar's reasoning, typically in response to a particular case, and are considered binding precedent by those Muslims who have bound themselves to that scholar, including future muftis; mere rulings can be compared to memorandum opinions. The primary difference between common-law opinions and fatwās, however, is that fatwās are not universally binding; as sharia law is not universally consistent and Islam is very non-hierarchical in structure, fatwās do not carry the sort of weight that secular common-law opinions do.
Some semi literate persons start calling themselves as Mufti and issue Fatwa on various matters, at times to please the beneficiary. In the heat of of elections 2013 in Pakistan, it is common to use Fatwa as a tool to ridicule the political opponents especially by the religious political parties. Such practice is not sanctioned by Islam and learned scholars reject it. Allah says:
"..nor sell My revelations for a small price, but have fear of Me"[Quran 2:41]

However use of religious motivation without issuing Fatwas against opponents is considered as acceptable, example below:
Molana Fazal ur Rehaman is a prominent leader of JUI (F). He has knack of deriving maximum benefits, while remaining ally of government and sitting at opposition simultaneously. Recently he was reported to have used the tool to undermine his opponent Chairman PTI, Imran Khan., calling him an agent of Jewish lobby (referring to his ex British wife, divorce years back). He has nothinng to support his allegation.
On the contrary Molana Fazal ur Rehaman is accused of seeking help from US ambassador to becomme Pirme Minister of Pakistan, the information became public through Wiki-leaks.
The Wikileaks secret cables exposed Rahman when he cordially invited US Ambassador to Pakistan, Anne Patterson, to a state dinner in Islamabad in which he sought her support in becoming PRIME MINISTER and expressed a desire to visit America. According to Rehman's personal aide, "All important parties in Pakistan had to get the approval" of the U.S. Referring to Rehman, Patterson mentioned "He has made it clear that....his still significant number of votes are up for sale"THIS IS NOT CONCOCTED STORY OR ALLEGATION, SLANDERS MOLANA Levels AGAINST IMRAN KHAN.
ALLAH says, in Quran 60:1. سورة الممتحنة
تُسِرُّونَ إِلَيْهِم بِالْمَوَدَّةِ وَأَنَا أَعْلَمُ بِمَا أَخْفَيْتُمْ وَمَا أَعْلَنتُمْ ۚ وَمَن يَفْعَلْهُ مِنكُمْ فَقَدْ ضَلَّ سَوَاءَ السَّبِيلِ in
holding secret converse of love (and friendship) with them: for I know full well all that ye conceal and all that ye reveal. And any of you that does this has strayed from the Straight Path.

NOW MOLANA SAHIB OPEN YOUR FATWA FACTORY AND ISSUE FATWA IF YOU ARE NOT LIAR, HYPOCRITE... YOU WILL NOT DO IT BECAUSE ONLY A MAN OF CHARACTER CAN DO IT.. REPENT ASK FORGIVENESS FROM ALLAH, HE MAY FORGIVE YOU. DO NOT REPEAT SUCH NONSENSE AGAIN IF YOU ARE A BELIEVER..

An other Molana retrieved his FATWA issued on the report of an Ahmadi women video campaigning in Loendon, which was used to defame Imran Khan. The point is that why should religious leaders issue FAtwas in such a haste, just on some video, every one knows that any type of video can be concocted with technology. Has he not read Quran 49:6
يَا أَيُّهَا الَّذِينَ آمَنُوا إِن جَاءَكُمْ فَاسِقٌ بِنَبَإٍ فَتَبَيَّنُوا أَن تُصِيبُوا قَوْمًا بِجَهَالَةٍ فَتُصْبِحُوا عَلَىٰ مَا فَعَلْتُمْ نَادِمِينَ
اے لوگو جو ایمان لائے ہو، اگر کوئی فاسق تمہارے پاس کوئی خبر لے کر آئے تو تحقیق کر لیا
کرو، کہیں ایسا نہ ہو کہ تم کسی گروہ کو نادانستہ نقصان پہنچا بیٹھو اور پھر اپنے کیے پر پشیمان ہو

We have to shut down these FATWA FACTORIES. If a common man like me knows what Quran says, why dont they? Then they get away with it by just issuing clarification. Shameless people have made fun of great religion Islam. Some one's dignity and reputation is involved, its slander, punishment is 80 lashes. They are fooling us like politicians. No more please raise your voice for proper certified Imams like many Muslim countries, why exception here?
There is no quick fix.. we have to start slowly ...
1) Run an Imam Diploma for all Mullah in mosques, with incentive or Rs.1000 for qualified Mullah.
2) Instead of Danish schools open govt Midrissa at at each district level, with free boarding lodging.. board of governors from local honest people not Mullah, trustworthy , fund with Zakat , sadqat.. teach them religion and some skill, electrician, carpenter, plumber, teacher etc. So that who do not get mosque, should get job/work.
3) Expand these Midaris, with higher education. Take example of Golkan Schools Turkey and others. Oxford was a initially a religious college. WE MUST DO SOME THING SOME MORE GOOD IDEAS may be explored ...
O' Allah save us from such Mullah. Government has left this sensitive matter to private Madaris, this is responsibility of Sate of Islamic Republic to impart proper education and training to get qualified Imams and Muftis. We failed in 65 years and enjoying fruits of Terrorism , extremism. WAKE UP TAKE IT SERIOUSLY ... RELIGION IS TOO SERIOUS MATTER TO BE LEFT TO MULLAH ALONE...
